A probability distribution is binomial if each event can have 2 outcomes only. Here, the response can have 2 outcomes, either a smartphone has been or has not been selected. Although the selections are not independent, they can be treated as independent by the 5% guideline, because 380 users are a lot less then 5%of smartphone users. Therefore the probability distribution is binomial.
