Is Johnny guilty? Should he be charged for killing Bob?

My friends and I are having a debate and I want to get more people opinions and reasoning. This takes place at the beginning of chapter 4 of The Outsiders. Let me know!

I'm pretty partial towards Johnny. Bob was drowning Ponyboy in a fountain. Johnny didn't know if Pony was dead or alive. Johnny was not big enough to knock a guy like Bob out so, in his panic, he did what he had to do.
