Why does Hamlet make the murderer of the play the nephew and not the uncle? Why mistaken message may the court get from the play?

I think the players were going for a theme rather than an out right accusation. Hamlet is too subtle to have the king's brother kill the king in the Mousetrap. The court may take the parallel literally but that was not Hamlet's intent. Hamlet just needed his suspicions confirmed.
