how do the pigs gain the rights to the cow's milk

The pigs simply take the milk. They justify this by saying that the milk helps make them intelligent (humans drink it) and they need all their smarts in case the humans try to come back to the farm. It's the whole fear thing. If the other animals are afraid that the humans will come back, they will give the pigs complete mandate in exchange for their (pigs) protection.
