The 14th amendment states that, "Its Equal Protection Clause requires each state to provide equal protection under the law to all people within its jurisdiction". Slavery was outlawed during the time of Mockingbird. The court had to appoint a lawyer to represent Tom regardless of his colour. Tom was lucky that Heck Tate asked Atticus, even though the outcome was not good.
